Please read these Terms of Service carefully before using SynqWe. By accessing or using the app, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account or using SynqWe, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the app on behalf of a household, you represent that all members using the app have agreed to these terms.

2. Description of Service

SynqWe is a household and personal wellbeing platform that helps couples and families manage schedules, tasks, nutrition, mood, finances, and communication — with optional AI-powered features. Core planning features work without AI. AI features are clearly labelled in the app.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@synqwe.com if you suspect unauthorised access.

4. Subscription & Billing

SynqWe offers free and paid subscription tiers. Subscriptions are billed through the Apple App Store or Google Play and are subject to their respective billing terms.

When you connect with a partner or household member, certain data is shared between accounts as described in our Privacy Policy. You are responsible for ensuring that anyone you invite to your household consents to the app's data practices. Private data (friction logs, personal mood details, brain dump entries) is never shared with your partner without your explicit action.

7. AI Features & Limitations

SynqWe's AI features (Aria assistant, image scanning, voice input, weekly insights, etc.) are powered by OpenAI and are provided for informational and organisational purposes only.

AI features do not constitute medical, financial, nutritional, legal, or psychological advice. Always consult a qualified professional for decisions affecting your health, finances, or legal matters.

AI responses may occasionally be inaccurate or incomplete. SynqWe Inc. is not liable for any decisions made based on AI-generated content.

8. Intellectual Property

All content, design, trademarks, logos, and software comprising SynqWe are the intellectual property of SynqWe Inc. or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

Content you create within the app (entries, notes, events) remains yours. You grant SynqWe Inc. a limited licence to process and store your content solely to provide the service.

Your use of SynqWe is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We never sell your personal data to third parties.

10. Disclaimer of Warranties

SynqWe is provided "as is" and "as available" without warranties of any kind, express or implied. SynqWe Inc. does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SynqWe Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

You may stop using SynqWe and delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice.

Upon termination, your right to use the service ceases immediately. We will delete your data in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which SynqWe Inc. is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.

15. Apple App Store Additional Terms

If you downloaded SynqWe from the Apple App Store, the following additional terms apply. Apple's Standard End User Licence Agreement (EULA) is incorporated into these Terms by reference and applies to your use of the app. In the event of a conflict between Apple's EULA and these Terms, Apple's EULA will govern with respect to your use of the App Store.

Apple is not a party to these Terms and has no obligation to provide any maintenance or support for SynqWe. Apple has no warranty obligation for the app. Apple is not responsible for any claims relating to the app, including product liability, legal compliance, or consumer protection claims. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
